TYLER, Texas (KLTV) - On Thursday, John Russell Hobbs was convicted of forgery, theft and money laundering. On Friday, jury members in Judge Austin Reeve Jackson’s court determined his sentence.
The state brought no sentencing evidence and rested its case after opening statements. The defense then began calling witnesses, including Billy Hibbs, who said he has known Hobbs, 64, for about 50 years. Hibbs said he was “completely astonished” at the jury’s guilty verdict and that, should the jury grant probation, he would continue to hire Hobbs to work for him to help pay restitution. Hobbs faces a prison sentence between five years and life, and a fine of $10,000 for each charge.
“He’s a very trusted friend,” Hibbs said.
When questioned by the state, Hibbs described Hobbs as “the most dependable person that I could ever call on.”
Terry Weiss, the father-in-law of Hibbs, said Hobbs “always stops to help somebody, and that’s an admirable quality.” Weiss said he’s known Hobbs since 1973, and also knew Betty Jo Collins, the victim of Hobbs’ theft. Weiss said Hobbs collected Collins’ mail every day.
Upon state questioning, Weiss said: “I can’t even imagine it. It just blows my mind,” of Hobbs alleged theft of $800,000 to $900,000.
Defense called witness Kirk Story next, who said he’s known Hobbs for 40 years after meeting as neighbors. Story said he and Hobbs are both Shriners.
A probation officer for Smith County was called last before the defense rested around 10:47 a.m. Closing statements and deliberation are set to begin upon court’s return.
Jury members ultimately decided to sentence Hobbs to 10 years for each charge, with each sentence carried out concurrently. He was given no fine to pay, but a hearing to determine a restitution amount will be held on March 28. Hobbs’ attorney said they plan to file an appeal.
